Xillo TruePotential: Terms & Conditions

Introduction & Ownership

Xillo TruePotential ("the Platform") is a cognitive development and leadership profiling service. The Platform is owned and operated by the National Zakat Foundation South Africa (NZF), a registered Non-Profit Company. By accessing or using Xillo, you agree to these Terms and Conditions.

Eligibility & Registration

Account Security: You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility.

Purpose: Xillo is designed for self-improvement and professional insight. It is not a medical or psychological diagnostic tool.

Subscriptions & Payments

• Payment Processor: All financial transactions are processed securely through Payfast on behalf of the National Zakat Foundation NPC.
• Billing Cycles: Paid tiers (Discover, Build, Optimize) are billed every 30 days.
• Automatic Renewal: Your subscription will renew automatically unless cancelled via your User Profile at least 24 hours before the renewal date.
• Pricing: Xillo reserves the right to adjust pricing with a minimum of 30 days' notice to active subscribers.

Cancellation & Refunds

• Right to Cancel: You may cancel at any time. Under the Consumer Protection Act (CPA), you have a 20-business-day notice period for fixed-term agreements, but for monthly SaaS, access typically continues until the end of the paid cycle.
• Refunds: As digital content is delivered immediately (cognitive reports and games), refunds are generally not provided for "change of mind" once the service has been accessed, in accordance with the Electronic Communications and Transactions (ECT) Act.
• Cooling-off Period: A 5-day cooling-off period applies only to transactions resulting from direct marketing.

Privacy & POPIA Compliance

Data Controller: The National Zakat Foundation NPC is the "Responsible Party" under the Protection of Personal Information Act (POPIA). Your use of the Platform is subject to our Privacy Policy.

Usage: Your cognitive data is used solely to generate your TruePotential™ profile. Anonymized data may be used for social impact reporting to the Foundation.

Intellectual Property

The "Intelligence Calculator," specific game mechanics, and the TruePotential™ reporting logic are the exclusive intellectual property of the National Zakat Foundation NPC. Users may not reverse-engineer, scrape, or commercially redistribute Platform content.

Limitation of Liability

Xillo provides insights based on cognitive performance data. While we strive for accuracy, the National Zakat Foundation NPC is not liable for any professional or personal decisions made based on the Platform’s results.

Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts in Durban, KwaZulu Natal.
